The new Tesla Roadster may have stunned everyone with its crazy performance claims, but there’s an interesting detail buried in the paperwork that prospective buyers should know about.

Even after putting down as much as $250,000, buyers aren’t actually guaranteed a car. Tesla’s reservation agreement states that the Roadster is still under development and that the company cannot guarantee when it will be delivered — or even if it will be delivered at all.

That’s quite a disclaimer for a car expected to enter production in 2028. The payment also doesn’t represent a confirmed order. Instead, it gives buyers an approximate place in line if Tesla eventually builds the car.

The final Tesla Roadster price isn’t locked down either. The company says the estimated price could change as it continues working on the Roadster’s equipment, options and hardware.

There is some reassurance, though. Reservations are fully refundable if buyers change their minds or Tesla cannot deliver the car. They are also non-transferable.

So, while the Roadster’s promised 0-60 mph time may be spectacular, buying one today still comes with plenty of uncertainty.
